New York Uniform Maintenance Pay Requirements
In New York, when an employer mandates that staff wear required uniforms, the cost of laundering and maintaining that required clothing cannot be passed onto workers. Under both the Hospitality Industry Wage Order (12 NYCRR § 146-1.7) and Miscellaneous Industries Wage Order (12 NYCRR § 142-2.5), employers must either clean the garments or provide weekly cash maintenance allowances.

The Wash-and-Wear Statutory Exemption
An employer is legally exempt from paying the uniform allowance if two cumulative conditions are satisfied:
- The uniform is constructed of wash-and-wear fabric that requires no dry cleaning, special laundering chemicals, pressing, or ironing, and can be washed with ordinary personal attire; AND
- The employer provides the worker with a sufficient quantity of uniforms free of charge, taking into account the number of days worked per week.
Commercial Laundering Exception
Employers who contract with an industrial laundry service or provide on-site laundry facilities at no expense to employees are also exempt from paying the weekly cash maintenance stipend.
