1. The Legal Requirement for Uniform Maintenance Pay
In New York, when an employer requires an employee to wear a uniform as a condition of employment, the law recognizes that cleaning and maintaining that uniform represents a real cost of business. If the employer does not maintain or commercially clean the uniform, they must pay the employee a weekly uniform maintenance allowance in addition to their regular wages.
2. What Qualifies as a Uniform?
Under 12 NYCRR § 146-3.10 and § 142-2.14, a uniform includes any clothing that is distinctive in style, color, pattern, or imprint:
- Clothing embroidered or printed with the employer’s company name or logo;
- Custom-colored garments (e.g., specific neon green shirts) not commonly worn outside work;
- Tuxedos, chef coats, aprons, or distinctive hats.
In contrast, ordinary general wardrobe requirements (e.g., "wear khaki pants and a navy blue polo" without company logos) do not constitute a uniform under New York law, provided the items can be purchased from any retailer and worn in ordinary street settings.
3. Mandatory Weekly Allowance Schedules (2026–2027 Confirmed Rates)
The required weekly allowance is stratified by the employee’s weekly hours worked and geographic region. Under the statutory economic off-ramp (NYLL § 652(1-b)(d)), the 2026 schedules remain in effect through 2027:
| Weekly Schedule | NYC, Long Island & Westchester (2026–2027) | Remainder of State (Upstate 2026–2027) |
|---|---|---|
| Over 30 Hours / Week | $21.10 / week | $19.85 / week |
| Over 20 to 30 Hours / Week | $16.75 / week | $15.80 / week |
| 20 Hours or Fewer / Week | $10.10 / week | $9.55 / week |
*Unpromulgated Dates Notice: Uniform maintenance allowances for calendar years 2028 and beyond have not yet been promulgated by the New York State Department of Labor. Our calculator strictly flags dates in 2028+ as unpromulgated rather than projecting speculative increases.
4. The Wash-and-Wear Exemption
An employer is exempt from paying the uniform maintenance allowance only if two cumulative tests are proven:
- Fabric Test: The uniform is constructed of wash-and-wear materials that can be laundered with other ordinary clothing without requiring dry cleaning, special pressing, starching, or specialized wash cycles.
- Quantity Test: The employer furnishes a sufficient quantity of uniforms without charge to the employee, considering the number of days worked each week (e.g., providing at least 3 to 5 shirts for a 5-day workweek).
