Pennsylvania Wage & Hour Statutory Framework

Statewide Minimum Wage Preemption

Under the PMWA (43 P.S. § 333.104), Pennsylvania’s basic minimum wage is $7.25 per hour. State preemption (43 P.S. § 333.105) bars municipalities from enacting higher private-sector general minimum wages. Philadelphia’s 21st Century standard ($17.63/hr for qualifying FY27 contracts, $16.82/hr transitional, $12.40/hr calendar 2026 grandfathered pre-April-2019) applies exclusively to municipal contractors and city-subsidized entities.

Chevalier v. GNC 40-Hour Salaried Divisor

In 2019, the Pennsylvania Supreme Court held in Chevalier v. GNC that nonexempt salaried workers must have their regular rate computed by dividing weekly pay strictly by 40 hours. Overtime is paid at 1.5× this rate in addition to base salary, strictly rejecting federal fluctuating workweek (FWW) 0.5× pay.

80/20 Tipped Worker Regulations

Under 34 Pa. Code § 231.101a and § 231.111, employers must pay at least $2.83/hr in direct cash wages. Employees must receive more than $135/mo in tips. Directly supporting work exceeding 20% of the workweek and all unrelated non-tipped work must be paid at full $7.25/hr.

Municipal Paid Sick Leave Ordinances

While Pennsylvania has no statewide paid leave mandate, Philadelphia (Ch. 9-4100), the City of Pittsburgh (Ch. 626), and Allegheny County (Art. XXIV) maintain enforceable sick leave ordinances. Under Allegheny County § 2411, employers in Pittsburgh follow city rules without duplicate county stacking.
