Key Rules of Pennsylvania Final Pay Law

Next Regular Payday Standard (43 P.S. § 260.5)

Unlike states that mandate immediate payment upon involuntary termination (such as California), Pennsylvania law treats all separations equally. Under 43 P.S. § 260.5, final wages are due no later than the next regular payday on which the employee would normally have been paid.

Vacation Payout Enforceability (43 P.S. § 260.2a)

Pennsylvania has no statutory right to paid vacation or automatic PTO cash-out. However, under the WPCL, if an employer promises paid vacation upon departure in an employee handbook, offer letter, or collective bargaining agreement, that promise is enforceable as statutory wages with potential damages.
