Overview of Michigan Employment & Wage Laws

Michigan's labor landscape underwent significant structural reform following the Michigan Supreme Court's 2024 ruling in Mothering Justice v. Attorney General, which invalidated the Legislature's 2018 "adopt-and-amend" strategy on voter-initiated minimum wage and paid sick leave measures. In response, the Michigan Legislature enacted 2025 Public Act 1 (amending the Improved Workforce Opportunity Wage Act) and 2025 Public Act 2 (amending the Earned Sick Time Act), establishing new multi-year statutory schedules effective February 21, 2025.

Minimum Wage

$13.73/hr in 2026, stepping to $15.00/hr on Jan 1, 2027. Covers employers of 2+ employees. Youth 16–17 rate is 85% ($11.67/hr in 2026).

Tipped Wage

Direct cash floor is 40% of minimum wage ($5.49/hr in 2026). Max tip credit is $8.24/hr. Tipped overtime floor is $12.355/hr.

Earned Sick Time

Accrues at 1 hr per 30 hrs worked. Annual paid use cap is 72 hrs (11+ employees) or 40 hrs (10 or fewer employees).

For wage disputes, unpaid overtime, or illegal paycheck deductions, Michigan workers may file a complaint with the Michigan Department of Labor and Economic Opportunity (LEO) Wage and Hour Division or pursue private civil actions under Michigan Compiled Laws.
