Understanding Michigan Final Wage Payment Laws

Regular Payday Requirement

Unlike California (which requires immediate payment upon discharge), Michigan law under MCL 408.475 allows employers to deliver the final paycheck on the regularly scheduled payday for the pay period in which the employee worked. This deadline applies equally to employees who resign, retire, or are discharged.

Vacation & Fringe Benefits (MCL 408.474)

Payment for accrued, unused vacation or paid time off (PTO) is governed strictly by the employment contract or written policy. If the policy guarantees payment or fails to establish a forfeiture clause, earned fringe benefits must be paid on the regular payday. Unused earned sick leave under ESTA is exempt from mandatory cashout (MCL 408.964(5)).
