Michigan Overtime & Regular Rate Calculator
Compute weekly overtime pay under MCL 408.934a and federal FLSA principles for hourly employees, fixed-salary arrangements (40-hour divisor), and lawful fluctuating workweeks.
Understanding Michigan Overtime Regulations
40-Hour Weekly Standard
Michigan enforces overtime strictly on a 40-hour workweek basis (MCL 408.934a). Unlike California, there is no daily overtime requirement for working more than 8 hours in a single calendar day. Premium pay is earned at one and one-half times the regular hourly rate.
Regular Rate Blending & Salaries
The regular rate includes all remuneration paid to the employee, excluding only statutory exceptions like gifts or true discretionary bonuses. When nondiscretionary bonuses are paid, they must be apportioned over all hours worked. For salaried nonexempt workers, weekly salary is divided by 40 hours to establish the base regular rate unless a valid fluctuating workweek agreement is proven.
