Illinois Final Paycheck Laws: IWPCA Deadlines, Vacation Payout & 5% Penalties

1. Statutory Deadline: 820 ILCS 115/4
In Illinois, final wage payments upon job separation are governed strictly by the Illinois Wage Payment and Collection Act (IWPCA), 820 ILCS 115/1 et seq.
Under 820 ILCS 115/4, an employer must pay the full final compensation of a separated employee no later than the next regularly scheduled payday for the pay period in which the separation occurred.
This deadline applies universally:
- Whether the separation is voluntary (employee resigns or quits).
- Whether the separation is involuntary (employee is terminated or fired for cause).
- Whether the separation results from layoffs or reduction-in-force.
2. Mandatory Accrued Vacation Payout: 820 ILCS 115/5
One of the most consequential provisions of Illinois wage law is 820 ILCS 115/5, which treats accrued vacation as earned wages:
“Whenever a contract of employment or employment policy provides for paid vacations, and an employee resigns or is terminated without having taken all vacation time earned, the monetary equivalent of all earned vacation shall be paid to him or her by the employer as part of the final compensation at his or her final rate of pay.”
Key legal nuances under 56 Ill. Admin. Code 300.520 include:
- No Forfeiture Upon Separation: An employer policy stating that accrued vacation is forfeited if an employee quits without 2 weeks' notice or is fired for misconduct is void and unenforceable under Illinois law.
- Pro-Rata Accrual: Unless the employer explicitly grants vacation only upon reaching anniversary milestones in a written policy, vacation accrues pro-rata as work is performed.
3. Paid Leave (PLAWA) vs. Vacation Separation Rules
A critical legal distinction exists between traditional vacation and statutory leave under the Paid Leave for All Workers Act (PLAWA, 820 ILCS 192/1 et seq.):
| Leave Type | Governing Statute | Final Pay Cashout Mandated? |
|---|---|---|
| Earned Vacation | 820 ILCS 115/5 | YES — 100% Mandatory |
| Standalone PLAWA Leave | 820 ILCS 192/15(b) | NO — Explicitly Exempt |
| Chicago Paid Leave (51+ Staff) | Chicago MCC § 6-130 | YES — Up to 40 hrs General Paid Leave |
| Chicago Paid Sick Leave | Chicago MCC § 6-130 | NO — Never Required to Cash Out |
4. 5% Monthly Late Payment Penalties: 820 ILCS 115/14
When an employer in Illinois fails to pay final compensation on or before the next regular payday, the employee is entitled to statutory civil penalties under 820 ILCS 115/14(a):
Statutory Late Payment Remedies
- 100% Back Wages: The complete balance of unpaid final wages and accrued vacation.
- 5% Monthly Statutory Penalty: Under 820 ILCS 115/14(a), a penalty of 5% of the unpaid wages for each month (or fraction of a month) the wages remain unpaid, payable directly to the employee.
- Administrative Penalty: Up to 20% penalty payable to IDOL for willful noncompliance.
- Mandatory Attorney Fees: Prevailing employees are entitled to reasonable attorney fees and costs under 820 ILCS 115/14(b).
